Claims & Agreement
  
        We strive to ship quality trees in good growing condition.  We exercise care to keep varieties true and will replace, upon proper proof, any stock that may prove otherwise.  We will not be liable for any amount greater than the original purchase price paid to us.  We are not responsible for delay in shipment or damage to stock from any cause after shipment is turned over to common carriers.
     Failure of trees may result from improper planting, lack of or excessive moisture, over fertilization, frost, freeze, etc.  Therefore, we cannot guarantee growth of trees once planted on customer's premises.  All claims against orders must be filed with our office within 10 days after delivery.  Shipping cost of replacement trees must be prepaid by customer. 
     Size of trees requested may vary up or down a grade.  If more than that is nessary to complete your order, we will contact you before shipment.
     Orders accepted by us constitute agreement to the terms listed above.

   Terms & Conditions
    All orders require a 50% Deposit due by October 31st, with the balance due prior to shipment.  If you have an established account with us, then the balance is due 30 days after shipment.  Any exceptions to this must be maed with our office prior to shipping.
     Orders less than $200.00 must be prepaid prior to shipment. 
     We accept Master Card and Visa credit cards.  Collection of past due account balances without our approved terms of payment will be subject to the maximum allowable interest and penalty charges.
     Shipping methods include UPS (prepaid at our rate) for smaller orders or Fed Ex Freight collect (at our rate) for larger orders.  Shipping costs and a box charg will be added to the cost of treed for UPS orders.  Arrangements may also be made to pick up your order at our location.  
 
All orders placed and accepted and delivered by Vaughn Nursery constitute agreement to all of the claims and terms and conditions listed herwithin.
